7 RIGHT OF WITHDRAWAL
7.1 Terms and conditions for the right of withdrawal, refunds and return of goods
Article 52 “Right of Withdrawal” of the Italian Consumer Code, in the event of a purchase on the Site, establishes that the User who is a consumer has a period of 14 days to withdraw from the contract, without having to provide any reason and without having to bear costs other than those provided for by Art. 56, paragraph 2 and Art. 57.
The Withdrawal Period in the case of sales contracts ends after 14 days from the day on which the consumer or a third party acquires physical possession of the goods or:
a. in the case of multiple goods ordered by the consumer in a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good;

The Product must however be stored, handled and inspected with normal diligence and returned, complete in all its parts, perfectly functional, accompanied by all accessories and information sheets, with the identification tags, labels and disposable seal, where present, still attached to the Product and intact and not tampered with, as well as perfectly suitable for the use for which it is intended and free from physical, aesthetic or superficial damage or alterations, tampering or improper maintenance or wear and tear or signs of wear or dirt; the Products must not have been used, worn, washed.
Furthermore, the withdrawal applies to the Product in its entirety. It cannot therefore be exercised in relation to parts and/or accessories of the Product.
In the event that the withdrawal has not been exercised in accordance with the provisions of the applicable legislation, it will not result in the termination of the contract and, consequently, will not give the right to any refund. 5.3 Delivery and transfer of risk of the products
Pursuant to art. 63 of the Consumer Code, any damage to the packaging/wrapping of the Products must be immediately contested by the User by placing a written control reservation on the proof of delivery. It is understood that, once the delivery document has been signed without any dispute, any exception regarding the external characteristics of the delivered goods will be precluded.
It is the User's responsibility to verify the conditions of the delivered Product. Without prejudice to the fact that the risk of loss or damage to the Product, for reasons not attributable to the Company Emme Custom Rod Studio di Marco Mutti is transferred when the User, or a third party designated by the User and other than the carrier, physically takes possession of the Product, the Company Emme Custom Rod Studio di Marco Mutti recommends checking the number of Products received and that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials and invites the User, in his interest, to indicate any anomalies on the carrier's transport document, accepting the package with reservation. 8.1 Information on Legal and Commercial Guarantees
All Products sold on the ecrodbuildingtackle.com Site are covered by by the Legal Guarantee of Conformity provided for by Articles 128-135 of the Consumer Code (Legal Guarantee).
The duration of the Legal Guarantee of conformity is two years from delivery of the goods.

The application to consumer Users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence is reserved.
10.1 Competent Court for Disputes
According to the Consumer Code (Legislative Decree 6 September 2005, no. 206), the Competent Court for Disputes in the case of a consumer User, for any dispute relating to the application, execution and interpretation of this document, the Court of the place where the User resides or has elected domicile is competent.

The User who resides in a member state of the European Union other than Italy may also access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, the European Procedure established for small claims, by Regulation (EC) no. 861/2007 of the Council of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 2,000.00. 11 INTELLECTUAL PROPERTY

14 Force Majeure
Emme Custom Rod Studio di Marco Mutti shall not be liable for any failure or delay in performing its obligations hereunder due to circumstances beyond the reasonable and foreseeable control of Emme Custom Rod Studio di Marco Mutti (hereinafter "Force Majeure Events").
Force Majeure Events include, but are not limited to, the following circumstances:
strikes, lockouts and other industrial disputes;
civil commotions and uprisings, invasions, terrorist attacks or threats of terrorist attacks, armed conflicts (declared or not) or threats or preparations for conflicts;
fires, explosions, storms, floods, earthquakes, epidemics or other natural disasters;
impossibility of using public or private means of telecommunications;
pandemics or epidemics.
The fulfillment of the obligations by Emme Custom Rod Studio di Marco Mutti under these General Conditions of Sale will be considered suspended for the period in which the Force Majeure Events occur. 15 Waiver

16 Invalidity of individual clauses
If any provision of these General Conditions of Sale is found to be illegal or invalid, it will not be considered as part of the General Conditions of Sale and this will not affect the remaining provisions which will continue to be valid to the maximum extent permitted by law.
